Section 1 - Employee Information and Verification
- Have the employee complete Section 1 at the time of the hire, which is the actual beginning of employment.
- If the employee cannot complete Section 1 by himself or if he needs the form translated, someone may assist him. The preparer or translator must read the form to the employee, assist the employee in completing section 1, and have the employee sign or mark the form in the appropriate place. The preparer or translator must then complete the Preparer/Translator Certification block on the Form I-9.
- The employer is responsible for reviewing and ensuring that the employee fully and properly completes Section 1.
Section 2 - Employer Review and Verification
- Employees must present to you (the hiring department) an original document or documents that establish identity and employment eligibility within three business days of the date employment begins. (This means no later than close of business on the employee's third day of employment).
- You (the hiring department) must fully complete Section 2 of the Form I-9.You must examine one document from List A or one from List B and List C. Record the title, issuing authority, number, and expiration date (if any) of the documents. Fill in the date of hire and correct information in the certification block and sign and date the Form I-9.
Section 3 - Updating and Reverification
- If an employee's name changed at the time this form is being updated/reverified, complete block A.
- When an employee's work authorization expires, you must reverify his or her employment eligibility. You may use Section 3 of the Form I-9, or if section 3 has already been used for a previous reverification or update, use a new Form I-9. If you use a new form, write the employee's name in Section 1, complete Section 3, and retain the new form with the original.
- A new Form I-9 is not required if an employee is rehired within 3 years of the date the Form I-9 was originally completed.
- If the employee is rehired 3 years after the date the original I-9 was completed, a new Form I-9 must be completed.
